Bankruptcy

Chapter 7 bankruptcy

If you are unable to pay back your debts as an individual or small business owner, our firm may recommend a Chapter 7 bankruptcy.  If you earn less than the median income in Florida, you probably qualify for Chapter 7.  When we file your petition, the bankruptcy court issues an automatic stay to prevent your creditors from making further collection attempts.  Our law firm helps you understand the federal bankruptcy exemptions, which allow you to keep many of your assets. Your other assets will be liquidated to pay back your creditors.  After you receive your bankruptcy discharge, you will be virtually debt-free.

Chapter 13 bankruptcy

If you are an individual who does not qualify for Chapter 7, you may be able to pay back your debts under Chapter 13 bankruptcy.  We work with you to draw up a structured repayment plan which will allow you to pay back your debts over three to five years.  A Chapter 13 bankruptcy can be preferable to Chapter 7 because—

  • You are assured of keeping your house
  • You can keep many more assets than in Chapter 7
  • The court reduces the amount of repayment that your creditors must accept
